I don’t know how many times or how many ways I have to say it: Benjamin Cardozo was not Hispanic, not Latino. Let it go, Jewish folks. And if you’re still unconvinced, read “Cultural Ettiquette: Why Jews Should Respect Sotomayor as the First Possible Latino/a Supreme Court Justice.
I have read books on Cardozo from ten years ago that debated if he was Hispanic, though the former Catholic in me has a somewhat odd prejudiced joy over the fact that John Paul Stevens will be the only WASP on the bench, and Alan Dershowitz can replace him.
My philosophy will be at odds with Sotomayor, especially as I don’t view the Constitution to be living and evolving, but she replaces David Souter, a liberal Justice, so no real concerns, though I hope she proves more Felix Frankfurter than William Brennan.
Now, there will be three New Yorkers on the Supreme Court, Scalia, Ginsberg, and Sotomayor.
